Why Operation American Spring is Unconstitutional

Angry-Mob-acwraith“It is impossible to read the history of the petty republics of Greece and Italy without sensations of horror and disgust at the distractions with which they were continually agitated, and at the rapid succession of revolutions by which they were kept in a state of perpetual vibration between the extremes of tyranny and anarchy.”  – Publius, Federalist Paper No. 9

For those who haven’t heard, Operation American Spring is a group of so-called patriots led by retired Col. Harry Riley, who are planning to demonstrate in Washington on May 16th. Their announced aim is to oust politicians they deem corrupt, and to replace them with politicians they like. OAS is claiming the authority of the Constitution and Declaration, to “throw off the bonds” of an unjust government and to redress grievances. There’s just one problem. Transferring power by these methods is totally unconstitutional. If we follow this lead, we can forget elections and voter sovereignty.

Any group of citizens can collect in public to air grievances and urge a course of action. They can speak to create a tension in the mind of the community. But OAS can’t claim to be restoring our constitutional republic by inviting ten million people to show up in Washington to throw people out of office outside the electoral process. Be they ten or ten million, no one voted for them to represent America; and they certainly do not represent the Tea Party, which has from the start been a constitutionalist movement. Riley and OAS represent only themselves.

In the Federalist Papers, Publius warned against exactly what OAS is, a faction: “…a number of citizens, whether amounting to a majority or minority of the whole, who are united and actuated by some common impulse of passion, or of interest, adverse to the rights of other citizens…” (Federalist Paper No. 10).

PubliusThe Founders took great pains to create a government that would prevent the changeable passions of a group in frenzy from imposing their will on the rest of the country.

Dr. Mickey Craig of Hillsdale College, puts it succinctly:

“The Constitution, while it is a popular government, it is a form of popular government which recognizes the disease of popular government, and has put in place institutional arrangements that will make it less likely that a factious or tyrannical majority will form and lead to the loss of liberty for the country.”

Operation American Spring is taking its cues from the populist Occupy and Arab Spring movements. The first brought destruction and anarchy to the streets of New York City and elsewhere. The second lead to the installation of one of the most tyrannical, fanatical leaders in Egypt’s recent history. This is horrifying enough. But more, they are preying on the well-meaning patriotism of many in the Tea Party movement, trusting that these same folks won’t see that OAS is completely antithetical to how we change power in America.

They are using the genuine and understandable frustrations of patriots who are fed up, citizens who see government out of control and want to do something to bring us back from the brink; from unsustainable debt, a government that won’t enforce our laws, a tyrannical health care policy that infringes on our liberties, and an economy and foreign policy that are in the toilet. They want to do something – something with faster results than our republican form of government allows. So here comes OAS with a call to action, miming Constitutionalism and encouraging the people to rise up and kick the corrupt bastards out via Washington sit-in.

constitution imaeThe slow, deliberative nature of our electoral process exists to temper the passions of just such a furious mob with its great potential for violence and anarchy. The constitution guarantees the peaceful transfer of power through the consent of the governed. It doesn’t matter how many papers OAS submits to Congress to get the Obama administration and John Boehner to resign. They can’t usurp and disregard our electoral process. To do so is to destroy the civil rights of the rest of the country who voted in 2012 and who certainly have a stake in November, 2014.

As Publius says in Federalist Paper No. 54, “This constitution will only work if the people choose men of wisdom and virtue to occupy the offices.” Where there are corrupt politicians, it is our duty as citizens to vote them out and vote in better representatives. Where there is voter or election fraud it is our duty to expose it and to stop it by requiring the same government-issued photo IDs we need to do everything else in our lives. Where millions are persuaded to vote for corrupt politicians and destructive policies, it is our job as citizens to persuade them otherwise. Where these problems are addressed we can begin to right the ship and save our country, no revolution needed.

Either Col. Riley and OAS are totally ignorant of what they are claiming to represent, or they are deliberately hijacking constitutional patriotism to enact what comes down to a coup – and mere months before our next election. Isn’t it ironic that a group claiming to restore our constitutional republic won’t use constitutional methods to do it?

Patriots from coast to coast should soundly reject Operation American Spring for exactly what it is: a tyrannical faction that is illegitimate, destructive, and unconstitutional.

The Only Important Question This Primary

The Only Important Question This Primary

There is only one important question this primary season: Will the candidate safeguard our sovereignty? There’s one easy way to tell, one policy, beyond which all other policy stances are irrelevant. Amnesty for illegal immigrants. Not jobs, the economy, foreign policy, health care, or anything else you can name. Illegal immigrants are taking our jobs, using our schools and health care system at taxpayer expense, and committing violent crime with impunity. And of course, they are voting in our elections. We already know there are 35,000 cases of suspected fraud in North Carolina alone according to the NC Board of Elections. Putting tens of millions on the “pathway to citizenship” will only exacerbate voter fraud and make it more difficult to stop. We’re not enforcing our immigration laws as it is. What’s to ensure the 30 million who broke our laws to get here comply with the new Amnesty laws, whatever they turn out to be? In the meantime, if we’re not requiring voters to prove who they are with government-issued photo ID, then our votes are no longer sovereign, and no other policy stance matters. I guess that makes me a one-policy voter.

Safeguarding our sovereignty requires a solid stance against illegal immigration and Amnesty. Otherwise, a candidate’s just vying for control of the Titanic. If you believe in a pathway to citizenship like Mark Harris, or you were a lobbyist for Big Agriculture and cry that farmers can’t survive without illegal labor like David Rouzer, or you gutted E-verify making it easier for businesses to hire illegal labor like Thom Tillis, then it’s simple: you’re not safeguarding our sovereignty because our basic right to vote is nullified when anyone, including illegal immigrants, can vote and not have to prove they’re eligible. So these men are not equipped to take that oath of office wherein one promises to “support and defend the Constitution of the United States against all enemies foreign and domestic.” I took that oath when I joined the Marines. My husband took a similar oath when he became a citizen. It’s nearly identical, “I will support and defend the Constitution and laws of the United States of America against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same…”.

The oaths of office matter, as do the sanctity of our votes and whom we choose to represent us. That’s why it’s easy to support men like Greg Brannon for U.S. Senate and Woody White for NC’s 7th District. I vetted both candidates in person before lending my support. Brannon is a constitutional encyclopedia, we know exactly what his guidebook is when it comes to policy. Secure borders and opposition to Amnesty are no brainers. With so many assets – an intelligent, well-spoken, pro-life doctor with a big beautiful family from all over the world – backing him is a no-brainer against Thom Tillis, who supported Common Core, state exchanges for Obamacare, brought us toll roads and is backed by the likes of Karl-guaranteed-to-lose-Rove. It’s easy to support Woody White, a conservative comfortable with something the GOP fails at: making the conservative argument to get government out of our way to prosperity and security. He’s also been very accessible, visible and has a fire in his belly to represent us in DC. Here in NC7 we have an open dialogue with him which we will continue when he wins. Meanwhile David Rouzer is dogging lawyers in DC, yet has one publicly fundraising for him, a Democrat lawyer and lobbyist, Rufus Edmisten, who abruptly resigned as NC’s Attorney General just as his offices were being audited. And while his latest mailer touts his supposed strength on illegal immigration, he lobbied for Big Ag in 2007 so they could get their cheap labor and in 2011 said he supported a pathway to citizenship in a Duplin county public meeting.  It doesn’t take much to figure out where his loyalties lie, and what he’s likely to do in Washington.

In today’s elections we don’t just need candidates who will keep the status quo, managing the Titanic as it sinks along with Boehner, Cantor, and Rove. This is not a contest for the faint and weak. The liberal opposition is playing for keeps, and there’s nothing they won’t do to win. We need representatives who fight the corrupt establishments of both parties. I’ll take the constitutional conservatives who are not afraid to argue.

“American Spring” Will Destroy The Republic It Purports to Preserve

Retired Colonel Harry Riley via Patriots of America has announced “Operation American Spring,” a march on Washington this May intended to oust the Obama administration. I completely understand the desire to overthrow these louts. It’s not just Obama and Democrats, there are a lot of Republican enablers that should go too. I know people are at their wit’s end and searching for bold solutions. The OAS plan, however, is ill-conceived, shows terrible judgment and in all likelihood will not bring about the intended results.  In fact, it will destroy the very Republic we are trying to conserve and discredit conservatives forever.

This is the plan:

Phase 1 – Field millions, as many as ten million, patriots who will assemble in a non-violent, physically unarmed (Spiritually/Constitutionally armed), display of unswerving loyalty to the US Constitution and against the incumbent government leadership, in Washington, D.C., with the mission to bring down the existing leadership. Go full-bore, no looking back, steadfast in the mission.

Phase 2 – One million or more of the assembled 10 million must be prepared to stay in D.C. as long as it takes to see Obama, Biden, Reid, McConnell, Boehner, Pelosi, and Attorney General Holder removed from office. The senior republican in the US House of Representatives will become Speaker of the House and the US House of Representatives will elect a temporary President and Vice President of the United States. The U.S. Senate will take action to elect a new majority and minority leader.
As required, the U.S. Congress will execute appropriate legislation to convene new elections or U.S. States will appoint replacements for positions vacated consistent with established constitutional requirements.

Phase 3 – Those with the “principles” of a West, Cruz, Dr. Ben Carson, Lee, DeMint, Paul, Gov Walker, Sessions, Gowdy, Jordan, will comprise a tribunal and assume positions of authority to convene investigations, recommend appropriate charges against politicians and government employees to the new U.S. Attorney General appointed by the new President.

*All actions in Phase 2 & 3 will be consistent with the U.S. Constitution.”

constitution imaeThe second and third phases show an alarming lack of understanding of our Constitutional Republic (despite the asterisked qualifier) and a terrible lack of foresight.  This by definition is an unconstitutional means of trying to transfer power.  It is more along the lines of insurrection or secession or worse, the French Revolution.  Many might be on board with either or both of those, but that too shows a total lack of foresight and good judgment.  It is very likely that the representatives mentioned in Phase 3 would absolutely oppose these methods.

OAS is laid out as if the whole thing will happen in a vacuum without opposition.  It is highly likely that Obama would use such a protest to his own advantage, and he could do so in all sorts of ways.  He can argue how extreme conservatives are that they would use unconstitutional means to bully duly elected representatives they don’t like out of office (and he’d be right).  He can afford to wait out protesters who will supposedly “stay as long as it takes,” thereby completely undermining their mission.  Then the headlines will be “OAS Fails, Leaders Embarrassed.”  1.8 million may have already signed up, but once the action begins, few of them will actually be willing to lose their jobs, their homes (especially those with families to consider) or to suffer the discomforts of living on the streets of Washington D.C. for a protest that at best will be completely ineffective.  This is not a comment on a Patriot’s resolve, this is a recognition of human nature.  Surely a colonel, of all people, should know how precarious keeping people together and focused on a mission can be, in the best of conditions.  Add in bad living conditions, hunger, conflicting egos, potential violence, and you’ve got a big fat mess that professional military leaders themselves often have a hard time mastering.

TeaPartyByFreedomFan

What may start like this…

...can easily end up like this.

…can easily end up like this.

Who’s calling the shots here, whether it’s for one or ten million people; Col Riley all by himself?  Who else?  What qualifies them to lead an action like this?  Will they be responsible for the people who, as Riley says, may die in this endeavor?  That is a responsibility true leaders must bear, especially those instigating a rebellion.  If not, it’s every man for himself, a recipe for mayhem.

How exactly will those listed be “removed” from their duly elected offices? This is supposed to be a peaceful and unarmed movement, but such a thing cannot be done without force.  Nor can it be done constitutionally via a sit-in, however long it may be.

How will they deal with and respond to opposition or counter-protest?  Leftist Occupiers are much better at this than conservatives, who are already predisposed with a solid sense of responsibility.  The Obama supporters likely to mobilize are also particularly adept at goading, they are unafraid to use violence, of get hurt or arrested.  It won’t matter that this is supposed to be an unarmed, peaceful protest.  Once something starts, it won’t matter that the conservatives who before have never instigated violence and have left the Mall spotless, didn’t start it.  What will they do if the people, as mobs are apt to do, get out of control?

How will they respond when Obama sends in the troops to clear the city as Hoover did against veterans during the Great Depression?  The protesters will then have instigated a stand-off with the American military which has a grave potential of ending very badly for all.  What if the administration decides to declare martial law because of this “insurrection?”  How will either the protesters, Americans, or our Constitutional Republic benefit?

If OAS gets as far as ousting the administration, how will they (all 1-10 million of them) control what happens next?

  • Who is to say that all 534 in the House of Representatives could come to agreement on who the temporary president and vice president should be?
  • How will the government not devolve into complete chaos while the administration is being replaced?
  • Have they considered the international repercussions of sending our government into complete chaos?
  • How will the votes of the newly convened elections be counted and how will voter fraud be avoided and accounted for?
  • What will these people do if the votes don’t go the way they think they should?
  • What can they do to ensure order and non-violence indefinitely, “as long as it takes”?

If OAS succeeds, it paves the way for this kind of ouster by liberals of conservatives duly elected to office. Conservative patriots fighting to save our country from this administration stomping all over our Republic and the liberties it guarantees would agree, that’s not what we want.

In his (rather badly written) announcement, Col Riley asserts that we are past the point of no return, among other platitudes.  I would argue: not nearly.  Yes, this administration is destroying our country.  Yes, our supposed representatives in Washington D.C. are defying the Constitution and Declaration of Independence and flouting our laws.  Yes, they are tyrannical and corrupt.  But all that, which has been obvious to conservatives since Obama jumped into the running in 2007, is becoming obvious to many, many more Americans.  The administration is being exposed more every day for its corruption, and the people are waking up to the mistakes they have made in voting for this president, Democrats and establishment Republicans.  It’s more than just conservatives who are now seeing through the sham that is political correctness.  America and her citizens are very resilient, just look at Scott Walker’s Wisconsin.  Fomenting a rebellion just when the administration is crumbling on itself is the stupidest thing anyone could do.  This “plan” is no plan at all, and the very people they want on their side and more will turn resolutely against them for it once the dust has settled.

Operation American Spring won’t save the Republic, it will destroy it.  Conservatism will be completely discredited because all conservatives will be lumped in with Col. Riley and his thoughtless, rash cohorts.  This is not pledging lives, fortunes and sacred honor to the cause of liberty, it’s throwing all of those away for confusion and mayhem that has a very high potential for leaving us much worse off afterwards.  Our best avenue to restoring free America is to persuade people to conservatism, to stop voter fraud and win back the country through elections, the peaceful transfer of power.

NC Patriots Gather to Celebrate the Constitution

crowdOn September 17th, 1787, our Founding Fathers gathered at the Constitutional Convention in Philadelphia and signed our most sacred document next to the Declaration of Independence, our United States Constitution.  In celebration of the 226th anniversary, North Carolinians from all over the state gathered at Jemeokee Park in Pinnacle, NC for the 3rd annual North Carolina Constitution Day TEA Party Rally.  Hundreds gathered throughout the day to hear speakers who reaffirmed our Founding principles and our Constitutional rights.  Many spoke of the urgency for action as these rights are continually eroded by our current administration, from the impending implementation of Obamacare, to Common Core in our schools, to our continuing struggle to maintain our second amendment rights, and much more.

The family-friendly event, planned by Kevin Shinault, and Stephen Bennett, was emceed by Bill Flynn, author and Truth Broadcasting Radio Host of The Eagle AM980, and U.S. Army vet and NC conservative icon Major Dave.  Featured speakers included NC Lt. Governor Dan Forest, Jan Morgan, award winning journalist, nationally recognized 2nd Amendment Advocate/Speaker, firearms instructor and founder of Armed American Woman; and former US Navy SEAL Ben Smith.  Many others also spoke including U.S. Senate candidates Dr. Greg Brannon, Mark Harris, and Heather Grant, Blogtalk radio personalities, local Tea Party leaders and activists including the creator of the 2 Million Bikers to DC, Belinda Bee, and even an actor playing George Washington.  I was excited to be able to say a few words on being a political animal.  See the full speaker list at the end of this article.  There were vendors, raffles, food and music, and the weather could hardly have been more pristine.

One attendee, Irene, said, “Today, I am invigorated!  I get so much energy from being around this wonderful group of people. We love our country, and recognize that the Constitution is the key, liberty and freedom are second only to God and the free market is the most powerful force in lifting people out of economic despair.”

Constitutionalists and Tea Party activists across the nation continue in the struggle to maintain our liberties and freedom in America.  Like-minded individuals band together at gatherings like these to show unity, to network and to help each other to take action in the defense of liberty.  Despite targeting by the IRS, spying by the NSA, and constant demonizing from their opponents, events like the NC Constitution Day Rally show that the Tea Party movement is far from over.  More TEA please!

Out-Pandering the Panderer-in-Chief

It was bad enough when Emperor Obama announced his June 15 decree to bypass Congress and grant legal status and work permits to 800,000 illegal immigrants.  Even worse, however, was that Romney and the Republicans have completely ignored that this is an unconstitutional, impeachable act.  Where is the outcry against this Tyrant in Chief?  The silence is deafening.

Romney doesn’t care that Obama has acted unconstitutionally, he’s fine with it.  He’ll have that power for himself if his spinelessness doesn’t cost him the election.  And as Obama made his move pandering to Hispanics for their votes, Romney is doing exactly the same.  He’ll staple green cards to diplomas?  He wouldn’t have the constitutional right to do so.  He won’t repeal Obama’s executive order?  Of course not.  Both parties are the same, neither acting according to the Constitution and varying only by slight degrees.

This is no alternative to Obama and it gives the lie to Romney’s campaign slogan, “Believe in America.”  If he did he would be talking about those principles that make America great and that foster the desire to become American through legal immigration.  He would be talking about how thwarting and undermining the Constitution hurts the citizens, including legal immigrants, whose rights are guaranteed and protected by it.

As Romney dangles green cards and other incentives in exchange for Hispanic support, so will he lose the support of mainstream America – you know, the ones affected by illegal immigration.  He should be campaigning on American Conservative values – fiscal responsibility, strong national security, smaller government and the like – because these are good for all citizens regardless of race, religion or creed.  Instead, he feints left to out-pander the panderer-in-chief.

Posing as an opponent to big government, Romney’s declarations would expand the bureaucracy of the already overwhelmed legal immigration system.  Legal immigrants currently going through the process will be shoved aside just as they will be because of Obama’s June 15 pronouncement.  Focusing on a tiny group at the expense of the rest, he makes clear his disregard for the rule of law, the suffering economy and the lack of employment.  Romney shows that he, too, will say whatever he wants in order to get elected.  This is our alternative to Obama?

Maybe it’s time for a Scott Walker write-in.

Grandfathering in Illegal “Youth”

On Friday Obama decreed that illegal “youth” under 30 who’ve been here more than 5 consecutive years will be granted legal status and work permits.  This dictatorial step is just one of many steps he has taken ignoring his oath to uphold the Constitution, let alone to operate within the powers allotted him by our Constitutional Republic.  As he takes this step, many on the Left have already been working to prevent voter ID laws from being put in place to prevent voter fraud (many on the Right have not done enough to oppose this).  Grandfathering in millions of illegals who won’t have to show that they are citizens will result in even more voter fraud than is already taking place.  If that happens and Obama wins a second term, it will be the Republicans’ fault for not opposing this move, requiring proof of citizenship to vote, and on a broader scale sitting on their hands with regard to illegal immigration and border security.

This will also add to our economic nightmare.  Legal immigrants will be pushed aside as the government employees who currently handle immigration cases will have millions of new cases dropped in their laps.  The cost will be staggering and of course will be placed squarely on the backs of the taxpayers.  As my husband has been going through the legal immigration process and we have been doing everything according to the law, it is unfair and infuriating for Obama to kick aside law abiding legal immigrants and to burden the taxpayers with the expense of executing his plan all so he can widen his voting base.

Obama (and all who are for amnesty for illegals) will deprive the 20+ million unemployed AMERICANS of jobs for which they are desperate.  He talks out of both sides of his mouth, first as he delivered this “decree” Friday but then alternately as he also says he won’t rest until everyone in the country has a job.  Proponents of amnesty ignore the great cost to American citizens: in jobs; in the $2.5 billion (in NC alone) in tax-payer-funded services such as hospitals, prisons and schools; in American kids losing spots in classrooms that are being taken up by illegal immigrants; in the closing of schools and hospitals;  in the Mexican drug cartels taking over national park areas and they and other criminals who have taken hundreds of lives a year.

When Obama or anyone else says illegal immigrants are just good, hard-working people, it’s a lie – not because many are not well-intentioned or hard-working – but because they can’t possibly know who is well-intentioned and who isn’t.  They haven’t interviewed them all, they haven’t examined all of their backgrounds and reasons for coming to America.  That is the job of immigration officials – the part they all skipped.  We know too well that the federal government is not enforcing its own immigration laws, now we’re being told that this incompetent administration is going to do the job on millions more?  They can’t even keep known criminals that they deport out of the country!  What we do know about all illegal immigrants is that regardless of their intentions, their first act coming to this country was to commit a crime, to come into the country illegally.  We know that they did not care about our Constitution or our laws enough to follow them.  We know that many are taking advantage of our tax-payer provided services, and therefore stealing from the taxpayers.  Those that we’re told are “good tax-paying workers” are committing fraud if they have tax ID numbers.  Knowing that, it’s totally absurd to make blanket statements about their goodness.  Not to mention they don’t give a crap about good, hardworking, tax-paying American citizens!

This also promotes racism against Latinos.  When immigration laws are being enforced, the general public knows that those they see on the street, in the schools, in the workplaces have a right to be here.  Because the laws are not being enforced, average people don’t know if the Latinos they see every day are there as law-abiding people applying to be or already Americans or are a burden on them as outlined in the previous paragraph.  This will inevitably breed suspicion and resentment that would not exist if the laws were being enforced.  It has nothing to do with actual racism: circumstances that favor one group unfairly while not protecting another are going to have this result.

Both parties are promoting their own brand of this same act.  Marco Rubio is making his own version of the Dream Act wherein children will be granted amnesty, which inevitably means their families will be granted amnesty as well because (whine) “you caaaaaaaaan’t separate the faaaaaaamilies!”  Romney was slow and flimsy in his response to Obama’s Friday announcement.  Republicans from the top down are being told to keep quiet on illegal immigration.  The Democrats are all for illegal immigration, the Republicans are spineless in dealing with the problem seriously and effectively.  On the one hand the Left wants a wider set of Democrat voters, on the other the Right is in bed with Big Business and cheap illegal labor.  Both are willing to do more for illegals than for American citizens, yet whomever next becomes a citizen will be the next group each will try to exploit.

We certainly have to confront the problem of children who are not of legal age to have made the decisions to break our laws.  If our elected officials would close the door and turn off the faucet, then we could get to mopping and drying.  And then a nice buff and wax.
